The management of PT Dana Syariah Indonesia (DSI) is undergoing trial on allegations of the criminal act of embezzlement of the Dana Syariah investment product at the Depok District Court. The founder and former director of DSI, Atis Sutisna, is separately charged with allegedly possessing the proceeds of embezzlement in the case numbered 370/Pid.B/2026/PN Dpk. Meanwhile, Taufiq Aljufri as president director, Arie Rizal Lesmana as commissioner, and Mery Yuniarni as former director are charged with committing the criminal acts of embezzlement and fraud in the case numbered 309/Pid.B/2026/PN Dpk. In addition, Fithri Hadi, the husband of Mery Yuniarni, who was a Financial Services Authority (Otoritas Jasa Keuangan/OJK) official and was advertised to the public as a Founder and Advisor of DSI, has also been named a suspect due to his involvement.
The Public Prosecutor charges the management of DSI with violating Articles 488 and 486 of the Criminal Code, which describe embezzlement as an act where someone “…unlawfully possesses an item that is wholly or partly owned by another person, which is in their possession not because of a Criminal Act…”. The Public Prosecutor also charges Article 492 of the Criminal Code, which regulates fraud as “…unlawfully benefiting oneself or another person by using a false name or false position, using trickery or a series of lies, inducing a person to hand over an item, grant a loan, make an acknowledgment of debt, or annul a debt…”.
In addition, the Public Prosecutor also charges the management of DSI with violating the Electronic Information and Transactions Law (ITE Law) regarding the transmission of false information that causes material loss in electronic transactions, as well as violating the Law on the Development and Strengthening of the Financial Sector (P2SK Law), which prohibits false recording, removing, or obscuring information in business activity reports. The charges are based on the discovery of evidence such as financing deeds and project contracts that the Public Prosecutor considers fictitious after comparing them with audit reports and samples of genuine contracts.
After the Interlocutory Ruling, which determined that the objections from the management of DSI were not accepted by the Panel of Judges, the evidence is now being examined together with witnesses who provide clarity regarding operational responsibility and the flow of transactions in and out of DSI. However, the examination of witnesses in Case Number 370/Pid.B/2026/PN Dpk was briefly delayed when Atis Sutisna required hospital care due to gout complications, rendering him unable to give testimony in good health.
Meanwhile, in the examination of witnesses in Case Number 309/Pid.B/2026/PN Dpk, a borrower, or user of DSI’s financing services, was found to have had one financing application split into 123 loan contracts. The borrower stated that this was done without their knowledge, confirming the manipulation of data to include fictitious borrowers in DSI’s business activities. Currently, the trial is still ongoing to examine various witnesses and experts presented by the Public Prosecutor.
The victims, who are lenders, or investors who entrusted funds to DSI, have followed the restitution registration process through the Witness and Victim Protection Agency (Lembaga Perlindungan Saksi dan Korban/LPSK), who shall work with the Public Prosecutor in allocating the recovered assets. The fulfillment of the victims’ rights will be the main indicator of success in law enforcement against DSI’s financial crime. AMAR Law Firm & Public Interest Law Office, which represents 87 victims of the DSI embezzlement, naturally hopes for the Public Prosecutor’s victory in upholding criminal law against the embezzlement that has harmed members of the public and tarnished the reputation of the financial technology (fintech) sector in Indonesia.
